T&C’s

1. RESERVATION DEPOSIT AND PAYMENT OF BALANCE

The non refundable reservations deposit of £150 per week of booking or part thereof,  is payable with the completed booking form. Once received and accepted the booking will become valid.    The full balance is payable no later than 12 weeks prior to the date of arrival.  Once final balance is paid it is non refundable.

The lead guest that makes the booking on behalf of his/her party  must be over 25 years of age must agree to these terms and conditions and have given warranty that they have the authority to act on behalf of the persons named on the booking form.  The maximum occupancy of the villa is 8 or less plus (1 infant) .

The villa cannot be shared, assigned or sublet and can only be let to those persons whose names are recorded at the time of booking unless we subsequently agree to an amendment to the bookings in writing.  An adult must accompany any persons under the age of 18.

(In addition to these terms and conditions, Florida Law prohibits sharing, assigning and subletting.  Violations can result in evictions without compensation)

Any reservations obtained under false pretences will be subject to the forfeiture of all monies paid and you will not be allowed to check in.

2.  Rental Period 

The villa is available from 4.00 pm  local time on the day of arrival until 10.00 am local time on the day of departure.  No exceptions.

3. Additional Security Deposit

A security deposit of £200 GBP  is payable to cover breakage’s or damage
to the premises and or contents, telephone bills, cleaning costs other than
those normally incurred in connection with the occupation of the premises, but not including for example, the cleaning of carpets, upholstery, etc.  The security deposit is payable at the time of the final balance.                           The deposit is returnable subject to deductions to cover the expenses mentioned above within 21 days of vacating the premises.

4. Cancellations

If the balance of the sum as shown on the booking form remains unpaid 12
weeks prior to the date of departure the owner reserves the right to cancel the booking and, in this event, the deposit will be forfeited.  Any booking cancellation by the guest must be notified immediately by phone and confirmed in writing.  Notice of cancellation shall be deemed to have been received by us upon receipt of written confirmation.                                            Cancellation Charges  The following cancellation charges will apply:-   Notice received more than 12 weeks prior to arrival date – loss of initial booking deposit.                                                                                                               Notice received less than 12 weeks prior to arrival date – loss of all monies paid (Except security deposit which will be returned within 21 days)

Note:- Travel insurance may cover cancellations caused by unforeseen circumstances.

5. Unavoidable Changes

We (Owner) reserve the right in any circumstances to cancel the booking
and in this event we will return all sums (but without interest or compensation) or (at the option of the Clients and subject to availability)
we will offer alternative premises of comparable standard.
In the event of a major change to the booking being necessary we will inform the Client as soon as reasonably possible and, if the client
does not wish to accept the booking on this basis, we will
cancel the booking and return all sums (but without interest or compensation).

6. No Smoking Policy

The villa is strictly Non-Smoking. This keeps the villa clean and odour free, avoids triggering sophisticated smoke detecting system and is for your safety. Smoking is allowed on the pool deck.

7. No Pets

No pets of any kind allowed anywhere on the property

8. Damage, Loss and Breakages

The lead guest is responsible for any damage or breakages that may be caused to the villa or its contents and also for any loss of items from the villa during the stay.  The security deposit will be held against such an eventuality or any other breach of these Terms and Conditions.  The residue will be returned within 21 days of departure date.  Should the cost of damage etc. exceed the amount of the deposit held, the balance is to be paid within 21days of written demand.

9. Travel Documentation and Insurance

It is advisable to take out adequate Travel/Health insurance when you are traveling abroad to cover all eventualities. Cancellation due to guests not having the correct documentation will be charged the relevant cancellation fees.

10. Care of the villa

The guests are advised to read and become familiar with the advice given in the ‘Welcome Book’ supplied at the villa.  This books gives useful guidance on many topics associated with your holiday, including important safety information.

Please remember that this is a privately owned villa and should be left in a clean, tidy and undamaged condition, e.g. kitchen utensils and crockery should be cleaned and put away before leaving.  The villa will be carefully inspected upon departure and if not left in a suitable condition, charges will apply, ie for excessive cleaning costs, excessive use of electricity caused by leaving external doors open with the air conditioning on etc.  Strict: Electric Vehicles are not allowed to be charged at the property.

11. Antisocial Behaviour

Guests are asked to be considerate to the neighbours and to ensure that their actions do not interfere with the enjoyment of other residents on the Hampton Lakes community,  We particularly ask that guests do not make excessive noise or play loud music early in the morning or late at night. Strictly no parties or events.  Antisocial behaviour is usually reported to the local Sheriffs office and can lead to criminal penalties.  In the event that any guest behaves in a way that is likely to cause distress, danger or annoyance to any other holidaymakers or residents of Hampton Lakes or damage to any property, we reserve the right to terminate your rental agreement.  We will not be liable for any costs, compensation or refunds due to this action.

12. Swimming Pool

The owners and owner’s agents do not accept liability for injury, howsoever 
caused, as a result of the use of the swimming pool. Adults are specifically requested never to 
allow children unsupervised in the pool or decking area. Set the pool door alarm when appropriate.  Do not take glasses or bottles on the pool area.  It is recommended to use plastic
 tumblers, plates, etc. when “dining on the deck”.
Please also be aware that in Florida’s winter months, the temperature on occasions can be in the 30’s and 40’s Fahrenheit. Guests understands that pool heating takes 1-2 days to become effective after being turned on. Pool heat is on a timer and is set by management company. Electric pool heaters ( exchangers ) will not operate below 52 degrees F and the pool heater is rendered ineffective, and which the management company could not assist with. The owners are unable to return any payment for pool heating should the air temperature be too low for the pool heat to work.
The owners would not be responsible in this situation. The Jacuzzi is not a hot tub and is heated via the swimming pool circulatory system. Where available a pool blanket should be used by Guests to mitigate such reductions in temperature.

13. BARBAQUE

For health and safety reasons we do not supply a bbq.

14. Liability

The owners of the premises accept no responsibility whatsoever for death, personal injury, accidents, loss or damage to persons or personal effects however caused. The owners accept no responsibility whatsoever for any loss or damage or alteration to the terms of booking caused by events beyond their control including flight delays or cancellations, adverse weather conditions, fire, flood or industrial dispute, war or threat of war, riots, civil commotion, terrorist activities, industrial disputes, natural and nuclear disaster or force majeure.

15. Public Utilities

We accept no liability for the failure of public utilities such as water or electric.

16. Telephone

The villa is equipped with a telephone providing free local calls, free calls to UK landlines only.

17. Cable TV

Cable TV is provided in the villa.  The service level has been chosen by us.  No refund will be payable for outages, content, lack of content or personal preferences with regard to service.

18. Wireless Internet (Wifi)

High speed wireless internet is provided as a convenience free of charge whilst staying in the villa.  No refund of rent will be payable for outages, content, lack of content, personal preferences, speed, access problems or lack of knowledge of use with regard to this.

19. Insects etc.

The villa is regularly treated as part of pest control program and is professionally cleaned prior to your stay. Guests must be aware, however, that due to the sub-tropical climate of Florida insects, such as ants for example are occasionally inevitable and not a cause for complaint.

20. Security

Guests are responsible for their own security whilst staying at the property and should lock doors, shut windows, activate pool door alarm, etc when appropriate to do so.  We accept no liability for loss or damage for which guests are or could be insured or entitled to indemnify from a third party.

21. Security Cameras

For security reasons the Property is equipped with night vision security cameras at the front door and at the sides of the villa monitoring pool heating controls and equipment. Guests accessing or tampering with the pool heating equipment will result in the forfeit of the security deposit and the guests will be also be liable for any additional pool heating and other costs incurred which may include call out and repair charges. If in any doubt about the operation of the pool heating equipment the Guest should contact the management company.

22. Access for Owners and their Representatives

a) Routine maintenance.  The villa is subject to weekly pool and garden maintenance and the owner reserves the right for their local representatives to attend to these items at any reasonable time during your stay.

b) General Maintenance.  The owner or their representative reserves the right to be allowed access to the villa at any reasonable time for the purpose of maintenance and repair, after giving reasonable notice to the guest, except in the case of emergency.

c) Enforcing this Agreement.  The owner or their representatives reserves the right of access to inspect the villa at any time without notice in order to enforce the terms of this agreement if the owner has reasonable grounds to suspect that a serious violation has occurred.

23.  PARKING

Strictly NO parking on the grassed area on the drive and at the front of the villa, you will be issued with a violation order from the HOA for which you will be liable.

24. Complaints

25. Website Description

All website descriptions are made in good faith and every care is
taken to ensure their accuracy, but no liability will be accepted in the event of any errors or misprints.

26. Law Governing Our Agreement

These terms and conditions which relate to our booking agreement are constructed with and are subject to the laws of the United Kingdom and the parties submit to the executive jurisdiction of the United Kingdom courts.  If any parts of these terms and conditions are unenforceable due to statute of common law, the remainder shall remain in force.
